Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the Cue Band mobile application, the Lyre mobile application, the Lyre Admin web interface at lyre.cuebandapp.com, and related services (together, the “Services”) provided by Jeffrey Brown (the “Service Provider”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
The Services
The Services include:
- Cue Band Free — setlist management, song durations, and live performance timing for directors
- Cue Band Live — shared live sessions for director teams running performances
- Lyre Library — sheet music management and distribution for organizations
- Lyre mobile app — access to assigned sheet music for organization members
- Lyre Admin — web portal for directors to upload, map, assign, and publish sheet music
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Features may change, be added, or be removed over time.
Eligibility and Accounts
You must be able to form a binding contract to use the Services. Organization administrators are responsible for managing member access, assignments, and use of Lyre Library within their program.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify the Service Provider promptly if you believe your account has been compromised.
Your Content and Copyright
Cue Band and Lyre do not provide copyrighted sheet music. Directors and organizations are responsible for having appropriate rights to upload, store, and distribute music through Lyre Library.
By uploading, storing, or distributing content through Lyre Admin or Lyre Library, you represent and warrant that your organization has the rights necessary to upload, store, manage, and distribute that material to your members.
You retain ownership of content you upload. You grant the Service Provider a limited license to host, process, and display that content solely to provide the Services to you and your organization.
Acceptable Use
You agree not to:
- Use the Services in violation of any applicable law or regulation
- Upload or distribute content you do not have the right to use
- Attempt to gain unauthorized access to the Services, other accounts, or related systems
- Interfere with or disrupt the Services or servers and networks connected to the Services
- Use the Services to harass, abuse, or harm another person or organization
- Reverse engineer, decompile, or attempt to extract source code from the Services except where permitted by law
Subscriptions and Billing
Cue Band Free is free for directors. Cue Band Live and Lyre Library are paid organization plans billed annually unless otherwise stated at purchase. Lyre Library plans include Cue Band Live.
Pricing, member limits, and plan features are described on our pricing page and may be updated with reasonable notice.
Subscription fees for Cue Band Live and Lyre Library are collected through Stripe, a third-party payment processor. When you purchase a paid plan, you provide payment information directly to Stripe. The Service Provider does not store your full payment card details on its servers.
Paid subscriptions renew automatically at the end of each annual term unless you cancel before renewal. You are responsible for applicable taxes, if any.
The Service Provider may suspend or terminate paid access for non-payment or violation of these Terms.
Cancellation and Refunds
You may cancel a paid subscription at any time by contacting hello@cuebandapp.com. Cancellation stops future renewal charges. Access to paid features continues through the end of the current paid term unless a refund is issued under this section.
30-day money-back guarantee. If you are not satisfied with a paid subscription, you may request a full refund of that subscription's purchase price within 30 days of the original purchase date. To request a refund, contact hello@cuebandapp.com.
Refunds after 30 days. After the 30-day period, subscription fees are refundable on a prorated basis for the unused portion of the current annual term. The Service Provider will calculate the refund based on the time remaining in your paid term at the time of cancellation.
Refunds are issued to the original payment method when possible. Nothing in this section limits any refund rights you may have under applicable law.
Intellectual Property
The Services, including software, design, trademarks, and documentation (excluding your content), are owned by the Service Provider or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right to use the Service Provider's trademarks or branding except as needed to use the Services.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE PROVIDER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. THE SERVICE PROVIDER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID THE SERVICE PROVIDER IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE NOT PAID ANY FEES.
Termination
You may stop using the Services at any time. The Service Provider may suspend or terminate your access to the Services if you violate these Terms or if continued provision of the Services is no longer commercially reasonable.
Sections that by their nature should survive termination will survive, including provisions relating to content rights, disclaimers, limitations of liability, and governing law.
Changes to These Terms
The Service Provider may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where mandatory local law applies.
